The title deeds in Thailand

Land ownership is subject to Land Code BE 2497 (1954) and Agrarian Reform Code BE 2518 (1975)

Land can be acquired through purchases, leasing, donations, inheritances, repayment of debts. There are typically 4 types of title deeds; descending for the guarantee of ownership.

1) CHANOTE or title deed;
In English Title Deeds, it is the best of title deeds, it is registered; at the Land Office, there is no time limit to obtain it.
the rights are guaranteed by the Land Office which has measured; the terrain to the GPS
this title can be used to any reason such as a bank guarantee for a loan

2) NOR SOR SAAM KOR or Confirmed Certificate; Property
In English Confirmed Certificate of Use. This certificate confirms that the owner has the right to use the land. It can be obtained in the countryside outside urbanized areas or while waiting for a Chanote.
The owner is required not to leave the land unattended for more than 12 years.
It is registered at the Land Office. This title can be used as a bank guarantee for a loan.

3) NOR SOR SAAM or Certificate of Ownership
In English Certificate of Use. This certificate confirms that the owner has the right to use the land. It can be obtained in the countryside outside urbanized areas or while waiting for a Chanote.
The owner is required not to leave the land unattended for more than 12 years.
It is registered to the Land Office within 30 days.

4) SOR KOR NUNG or Certificate of Possession
in English Certificate of Possession
this certificate recognizes that the owner does own the land but does not imply that he has all the rights attached.
this title is not registered at the Land Office.
this certificate is not transferable, but the seller can sell his land and the new buyer will have a new Certificate of Possession.

In practice:
I remind you that a foreigner does not have the right to buy land.
A cautious foreigner will in many situations prefer a Chanote or a Nor Sor Saam Kor
But generally in the countryside such as in Issan, Buriram, etc...
The sale is voluntary. to gracious between the seller and the buyer in front of the Village Chief who will write for you the Certificate of Possession, also we can have from 2 to 4 witnesses
The remittance of money (cash or check) is done at the same time, there are no taxes to be paid. to pay.
Do not forget to pay around 100 baht to the Village Chief for the drafting of the deed.
For these sales it is recommended to buy land in his girlfriend's area to avoid later problems.
